License grant

The data agreement grants a nonexclusive, royalty-free, worldwide, non-transferable license to use, sublicense, copy, distribute, store, derive from, display, and make the provided data available to end users.

Main limits

  • the data may not be sold as received on a standalone basis without prior written approval
  • sublicensees must accept the same agreement terms
  • agency trademarks and logos cannot be used without separate permission
  • MTC reserves the right to publicize a registered disseminator’s use of the data

Attribution

The agreement requires visible acknowledgement near the user’s access to the data. The approved examples are:

  • data provided by 511.org
Both are intended to link back to http://www.511.org.

Operational obligations

  • use commercially reasonable efforts to keep public-facing data current
  • provide documentation of a launched product or service using the data within 30 days of launch
  • understand that MTC reserves the right to charge fees later with advance notice

Risk allocation

The agreement provides the data on an as-is, as-available, and with-all-faults basis. It disclaims warranties around accuracy, timeliness, completeness, and suitability, and it places indemnification obligations on the data consumer for harms arising from their use and dissemination.
